Alright, to start off I had been probing this gentleman for roughly a week. I finally found the opportunity and attacked. He ended up being online and shared a few choice words that really annoyed me. So I pretty much told him he wasn't invincible and ensured me that he was. Well a week had past and his fleet was just lying there so I ended up going in for the kill. Around 5 min until impact he ended up messaging me so I recalled and with him doubting I ended up attacking almost instantaneously afterwards I attacked again. This time I hit jackpot.
