Green Players not turning outlaw

I was spied on by a green player and they did not turn outlaw. They also had an incoming attack on me all the while they stayed green and I was not able to spy back to let them know I am online and I had enough defense to destroy the fleet anyway but since they seem new I didn't feel right liberating them of their small fleet.
